These Terms and Conditions ("Terms") govern your access to and use of the services, products, websites, mobile applications, and other offerings provided by Jyotisam (collectively, the "Platform") available at https://jyotisam.com (the "Site"). By accessing or using the Platform you agree to these Terms. If you do not agree with any part of these Terms, do not use the Platform.
1. Definitions
User — any person visiting or using the Platform. Astrologer — a registered service provider who offers paid consultations, content, or other paid services through the Platform.Team — Jyotisam and its employees, contractors, agents, and affiliates.
2. Acceptance of Terms
By using the Platform you represent that you are at least eighteen (18) years old or have parental/guardian consent to use the Platform. You agree to comply with these Terms and all applicable laws, rules, and regulations.
3. Changes to Terms
Jyotisam may modify these Terms at any time. When we make material changes, we will provide notice on the Site or by other reasonable means. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
4. Services & Availability
Jyotisam provides a marketplace and platform for users to find and pay astrologers for consultations, readings, content, and related services. The Platform may include schedules, messaging, content hosting, payments, reviews, and other features. All services are subject to availability and may be suspended, modified, or discontinued at any time.
5. Relationship with Astrologers
Astrologers operating on the Platform are independent contractors and are not employees, agents, partners, or representatives of Jyotisam unless expressly agreed in writing. Jyotisam does not provide astrological advice or guarantee the accuracy, outcomes, or efficacy of any astrological services. Each Astrologer is solely responsible for the services they provide and for compliance with local laws, licensing, and tax obligations.
6. Payment Processing, Fees & Platform Commission
All monetary transactions between Users and Astrologers are handled through payment processors selected by the Team. The Team will manage, process, and reconcile payments in accordance with the Platform's payment flow and applicable agreements with payment processors.
Platform Commission: Jyotisam charges a platform fee (i.e., commission) on payments made to Astrologers. The current platform fee is the percentage set forth in the Astrologer Agreement and displayed on the Platform or Dashboard (the "Platform Fee"). The Platform Fee may change from time to time; any change applies prospectively and will be posted on the Platform and communicated to Astrologers.
Team-handled monetary matters: The Team retains responsibility for payout scheduling, withholding of Platform Fees, statutory or contractual deductions (if any), refunds subject to the Platform's refund policy, and other payment administration tasks. The Team will make commercially reasonable efforts to ensure timely payouts, but payouts may be delayed for reasons including payment processor holds, verification, suspected fraud, compliance reviews, or legal requirements.
Taxes: Astrologers are responsible for determining and paying all taxes, contributions, duties, or withholdings required by law in their jurisdictions in connection with their earnings. Jyotisam may provide reports or information to Astrologers to assist with tax compliance but is not responsible for Astrologers' tax obligations.
7. Refunds & Cancellations
Refunds, cancellations, and chargebacks are governed by the Platform's Refund Policy. The Team may offer full or partial refunds at its discretion in accordance with that policy. In case of payment disputes, Jyotisam may temporarily withhold funds pending investigation.
8. Account Registration & KYC
Users and Astrologers may be required to register for an account to access certain Platform features. Astrologers may be required to complete identity verification, provide accurate personal and payment information, and comply with Know Your Customer ("KYC") and anti-money laundering ("AML") procedures. Jyotisam reserves the right to suspend, limit, or terminate accounts that fail verification or are suspected of fraudulent or illegal activity.
9. Prohibited Conduct & Anti-Fraud
You must not engage in any activity that: (a) constitutes fraud, deception, or misrepresentation; (b) attempts to circumvent fees, payment flows, or Platform controls; (c) posts, transmits, or stores illegal content; (d) abuses, harasses, stalks, or threatens others; (e) accesses other users' accounts without authorization; or (f) interferes with or compromises the security, integrity, or availability of the Platform. Accounts involved in scamming, cheating, or other prohibited activity will be suspended or terminated. The Team reserves the right to pursue civil or criminal remedies and to provide information to law enforcement when required.
10. Data Protection & Privacy
Jyotisam respects your privacy. Our Privacy Policy (available at /privacy or https://jyotisam.com/privacy) sets out the types of personal data we collect, how we use it, how long we retain it, how we share it, and your rights. By using the Platform you consent to the collection, use, and transfer of your personal data as described in the Privacy Policy.
Security: We use commercially reasonable technical, administrative, and physical safeguards to protect personal data. However, no method of transmission or electronic storage is 100% secure. You agree that Jyotisam is not liable for unauthorized access to data except to the extent caused by our gross negligence or willful misconduct.
11. Content, Reviews & Intellectual Property
The Platform may host content created by Jyotisam, Astrologers, and Users. Content provided by Astrologers or Users must not infringe third-party rights or violate laws. By submitting content you grant Jyotisam a worldwide, non-exclusive, royalty-free license to host, adapt, distribute, and display that content on the Platform and in related promotional materials.
All Jyotisam branding, site content, source code, designs, and other Platform materials are the property of Jyotisam and are protected by copyright, trademark, and other IP laws. You may not use Jyotisam's marks or content without prior written permission.
12. User Reviews & Ratings
Reviews and ratings help others evaluate Astrologers. Users must provide honest, lawful, and original reviews. Jyotisam may remove or refuse reviews that are false, defamatory, obscene, or otherwise in violation of these Terms.
13. Disclaimers & No Professional Advice
Jyotisam and its Astrologers provide spiritual and astrological services. Such services are for general information and entertainment purposes only and are not a substitute for professional medical, legal, financial, psychological, or other licensed advice. You should seek qualified professionals for such advice.
14. Warranties; Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JYOTISAM DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. JYOTISAM IS NOT RESPONSIBLE FOR LOSS OF PROFITS, REVENUE, DATA, OR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, EXCEPT WHERE PROHIBITED BY APPLICABLE LAW.
15. Indemnification
You agree to indemnify, defend, and hold harmless Jyotisam, its officers, directors, employees, agents and affiliates from any claim, demand, loss, liability, damages, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, violation of these Terms, or infringement of third-party rights.
16. Termination & Suspension
Jyotisam may suspend or terminate your access to the Platform for breach of these Terms, suspected fraudulent or illegal activity, or for any other reason in its discretion. Sections intended to survive termination (such as Payment, IP, Warranties, Limitation of Liability, Indemnification, and Dispute Resolution) will continue in effect.
17. Governing Law & Dispute Resolution
These Terms are governed by the laws of Nepal without regard to conflict of law principles. Any dispute arising from or related to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in Kathmandu, Nepal, unless the parties agree in writing to an alternative dispute resolution mechanism.
18. Export & Compliance
You must comply with all applicable export and import laws and regulations. You must not use the Platform in any manner that would violate such laws.
19. Notices
Jyotisam may provide notices by posting on the Platform, sending an email to the address associated with your account, or other reasonable methods. Notices to Jyotisam should be sent to: info@jyotisam.com.
20. Miscellaneous
These Terms, together with any documents they reference (including the Privacy Policy, Refund Policy, and Astrologer Agreement), constitute the entire agreement between you and Jyotisam relating to the subject matter hereof. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
21. Reporting Abuse / Fraud
If you suspect fraud, scamming, intellectual property infringement, or other abuse, please report it immediately to the Team at info@jyotisam.com with as much detail as possible. Jyotisam will investigate and may suspend or terminate offending accounts and cooperate with law enforcement as required by law.
22. Additional Terms for Astrologers
- Service Standards: Astrologers must provide services in a professional manner and comply with the Platform’s content standards and rules.
- Fee Disclosure: Astrologers must disclose any fees, extra charges, or prerequisites for a session (e.g., materials, recordings) clearly to Users before payment.
- Performance & Conduct: Astrologers must not make unlawful guarantees, misrepresentations, or promises of outcomes they cannot reasonably ensure.
- Records & Reporting: Astrologers must maintain records necessary for tax and payment reconciliation and cooperate with the Team’s verification or audit procedures.
23. Privacy & Cookies
For details on personal data handling, cookies, user rights (access, correction, deletion), and data retention, please review our Privacy Policy at https://jyotisam.com/privacy. The Privacy Policy is incorporated into these Terms by reference.
24. How to Accept These Terms
You accept these Terms by: (a) using the Platform after the Effective Date; (b) creating an account on the Platform; or (c) otherwise indicating acceptance where prompted. If you accept on behalf of an entity, you represent that you have authority to bind that entity to these Terms.
